What is Section 35?

Section 35 is a Massachusetts law that allows a qualified person to request a court order requiring someone to be civilly committed and treated involuntarily for an alcohol or substance use disorder.

How can I get out of Section 35?

Your Section 35 will end when the court says you do not need to be in hospital any longer. This may be if your responsible clinician tells the court that you do not need further assessment or your court case may finish or you may be sentenced.

How long can they keep you in rehab?

How long will I be there? Most programs run for 90 days (3 months) some only go for 1 month, some go for 6 to 9 months. Depends where you go. Sometimes court or FaCS will tell you how long they want you to go to residential rehab for.

Can you get discharged from rehab?

Can you force someone to go to the hospital?

A person can be involuntarily committed to a hospital if they are a danger to themselves, a danger to others, or gravely disabled. They are considered a danger to themselves if they have stated that they are planning to harm themselves.

What is a Section 45A?

Under section 45A the Crown Court can make a Hospital Order alongside a prison sentence (except where the sentence is fixed by law). This is often referred to as The Hybrid Order. The person also has the right to appeal to the Hospital Mangers and the section can be discharged by the persons Responsible Clinician.

How do I transfer from one rehab facility to another?

Usually, a nursing facility must give you, your guardian, conservator or legally liable relative a written notice, at least 30 days, and no more than 60 days, before a transfer or discharge from one facility to another. A shorter notice is allowed in emergency situations or for residents recently admitted.

Can you take a laptop to drug rehab?

Before you enter a drug rehab facility, you should check with the staff to see what electronics are or are not permissible so that you can be prepared. For example, if a drug rehab doesn’t allow laptops or e-book readers, you can be sure to bring some books or magazines with you to read.
