What cases does the ECJ hear?
The ECJ can hear cases from the national courts through the ‘preliminary ruling’ system. This involves a national court referring a question on the interpretation of EU law to the ECJ. The ECJ decides the correct interpretation and sends the case back to the national court for a final decision.
Under what circumstances is a national court obligated to make a referral to the European Court of Justice?
Any national court or tribunal which is called upon to decide a dispute involving EU law may, and sometimes must, submit questions to the Court of Justice for a preliminary ruling. The Court must then give its interpretation or review the legality of a rule of EU law.
